Terms of Service

1. Introduction

These Terms of Service govern your access to and use of Arkivre.

By creating an account, uploading documents, purchasing documents, downloading documents, or otherwise using the platform, you agree to these Terms.

If you do not agree with these Terms, you must not use Arkivre.

2. About Arkivre

Arkivre is a digital platform that allows users to upload, search, preview, purchase, and download notarial search documents and related records.

Arkivre acts as a technology platform and marketplace. Unless expressly stated otherwise, Arkivre does not create, verify, certify, guarantee, or legally validate the uploaded documents.

3. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to use Arkivre.

You must provide accurate account information and keep your login details secure.

You are responsible for all activity carried out through your account.

4. User Roles

Users may use the platform as:

  • buyers/search users;
  • uploaders/sellers;
  • notaries/legal professionals;
  • company or professional users;
  • administrators or authorised representatives of an organisation.

Certain features may require account approval or verification.

5. Account Registration

You agree to provide accurate, current, and complete information when registering.

We may suspend or terminate accounts that contain false, misleading, incomplete, or unauthorised information.

We may refuse registration or restrict platform access at our discretion where necessary for compliance, security, or platform integrity.

6. Use of the Platform

You agree not to:

  • use Arkivre for unlawful purposes;
  • upload documents you do not have the right to upload;
  • infringe third-party rights;
  • misuse personal data;
  • attempt to bypass payment or access restrictions;
  • copy, scrape, resell, or redistribute documents unlawfully;
  • interfere with platform security;
  • upload viruses, malware, or harmful content;
  • provide false or misleading document descriptions;
  • use the platform in a way that damages Arkivre, other users, or third parties.

7. Uploaded Documents

Uploaders are solely responsible for the documents they upload.

By uploading a document, the uploader confirms that:

  • they have the right and authority to upload it;
  • the document may lawfully be shared, previewed, sold, or downloaded through Arkivre;
  • the upload does not breach confidentiality, professional duties, data protection law, intellectual property rights, or any agreement;
  • the document title, category, and description are accurate;
  • the document does not contain unlawful, fraudulent, defamatory, misleading, or prohibited content.

Arkivre may review, remove, suspend, restrict, or delist uploaded documents at any time.

8. Purchases and Downloads

Buyers may purchase documents listed on the platform.

After successful payment, the buyer may receive access to download the purchased document.

Buyers are responsible for checking that the document appears relevant before purchase, including by reviewing available title, category, description, preview, and metadata.

Unless otherwise stated, purchases grant the buyer a limited right to access and use the purchased document for legitimate professional, legal, administrative, or due-diligence purposes.

Purchases do not transfer ownership of the document or intellectual property rights.

9. Pricing and Platform Fees

Arkivre may charge buyers on a per-page basis or through another pricing model displayed on the platform.

The current standard buyer price is €0.51 per page, unless otherwise stated.

Arkivre may charge uploaders a platform fee or commission on each sale.

The current standard platform fee is 20% of the sale price, unless otherwise agreed or displayed.

Arkivre may change pricing, commissions, or fees from time to time.

10. Seller Earnings and Payouts

Uploaders may earn revenue when their documents are purchased, subject to platform fees, payment-provider fees, refunds, chargebacks, taxes, and any applicable deductions.

Arkivre may withhold, delay, reverse, or adjust payouts where necessary due to refunds, disputes, suspected fraud, legal requirements, chargebacks, incorrect uploader information, or breach of these Terms.

Uploaders are responsible for any tax, VAT, accounting, invoicing, or reporting obligations arising from their earnings.

11. Refunds

Refunds are handled in accordance with our Refund Policy.

Because Arkivre provides digital document access, refunds may not be available once a document has been accessed, downloaded, or made available for immediate use, except where required by law or where Arkivre decides otherwise.

12. No Legal Advice

Arkivre does not provide legal, notarial, financial, tax, or professional advice.

Documents available on the platform are provided by uploaders or third parties.

Users should seek professional advice where required.

13. Document Accuracy

Arkivre does not guarantee that uploaded documents are accurate, complete, current, legally valid, suitable for your purpose, or free from errors.

Buyers are responsible for verifying documents before relying on them.

Uploaders remain responsible for the accuracy, legality, and rights relating to documents they upload.

14. Intellectual Property

The Arkivre platform, branding, design, software, text, layout, and functionality belong to Arkivre or its licensors.

Users must not copy, reproduce, reverse-engineer, or misuse platform content except as permitted by these Terms.

Uploaded documents remain the responsibility of the uploader or relevant rights holder.

15. Privacy and Data Protection

Our processing of personal data is described in our Privacy Policy and Cookie Policy.

Users must comply with applicable data protection laws when uploading, accessing, downloading, sharing, or using documents containing personal data.

To the maximum extent permitted by law, Arkivre shall not be liable for:

  • inaccurate, incomplete, outdated, or unlawful uploaded documents;
  • reliance on documents purchased through the platform;
  • loss of profit, business, revenue, opportunity, or data;
  • indirect or consequential loss;
  • user misuse of documents;
  • unauthorised uploads by users;
  • service interruption, technical issues, or downtime;
  • third-party payment, hosting, or service-provider failures.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

18. Indemnity

You agree to indemnify and hold Arkivre harmless from claims, losses, liabilities, costs, damages, and expenses arising from:

  • your breach of these Terms;
  • your misuse of the platform;
  • documents you upload;
